Agentului Guvernamental al Romaniei la CEDO

 

Subsemnatul Dimakos Ioannis, fiul lui Constantin si al Georgia, cetatean al Republicii Elene dosarul CEDO nr. 10675/2003 Dimakos vs. Roamania, adresa provizorie: loc. Certeze, Str. Draguiasa nr. 120, jud. Satu Mare.

D-le ministru al afacerilor Externe (si agentul guvernamental al Romaniei la CEDO) va aduc la cunostinta:

1.          In  data de 15.05.2009 CEDO a luat hotararea prin care a stabilit procedura pentru solutionarea cauzei si a stabilit termene la data de 04.09.2009 ca Statul Roman sa depuna o observatie impotriva admisibilitatii cererilor mele la CEDO din dosarul 10675/2003

2.          Cererile mele sa merg la CEDO sa iau copie dupa observatiile statului Roaman au fost respinse in 04.09.2009 intrucat Judecatorul Superior al CEDO a dat noul termen pentru a depune Statul Roman observatiile la data de 02.10.2009

3.          Dupa multele mele contacte telefonice cu CEDO am fost informat ca: Statul Roman la data de 02.10.2009 a depus prin posta observatiile. Din data de 02.10.2009 pana astazi actele respective nu au ajuns la CEDO. Deasemenea tot in data de 02.10.2009 Statul Roman a trims la CEDO observatiile sale prin fax. Actele nu pot fi examinate pentru ca nu sunt originale.

Dupa cele de mai sus mentionate, la data de 18.11.2009 am informat si Ministrul afacerilor externe din Grecia – Departamentul Cazuri juridice internationale si le-am  cerut ajutorul.

Prin prezenta va informez si pe Dumneavoastra urmatoarele:

-               Fiecare activitate a Statului Roman la CEDO este suspecta, singurul lucru pe care il faceti este sa amanati cazul, nu sa se solutioneze cauza. Eu personal cand am fost inchis si legat am fost in obligatiile mele corect si niciodata nu am intarziat nici un document care mi-a fost solicitat de Curtea Europeana.

-               Statul Roman, din data de 10.03.1998 pana la data de 20.06.2009, mi-a furat toate proprietatile mele din Romania, cu hotarari false ale tribunalelor necompetente si niciodata nu a respectat Conventia Europeana a Drepturilor Omului pe care a semnat-o in 1996.

Dupa cele de mai sus mentionate solicit sa terminati toate obligatiile Dumneavoastra pe care le aveti fata de Curtea Europeana a Drepturilor Omului si daca doriti o solutie amiabila va informez ca sunt in Romania si astept propunerea Dumneavoastra.

Dimakos v. Romania

 

As the following undersigning Dimakos Ioannis applicant against Romania address: Loc. Certeze, Str. Draguiasa no. 120, jud. Satu Mare:

-               Following the 15 of may 2009 from your letter that specify the process of litigation and, define the final – time on 2^nd September as long as Romanian State will be submitted their objections against the admissibility in my case.

-               Following your refusal to visit the registry of the court and pick up copies of the encounter of the Romanian State.

-               Following the decision of the Supreme Judicial Court of justice on 2^nd of September 2009 which has an extension for submitting encounter the Romanian State to 2^nd of October 2009.

-               Following my distress telephonic call, at the European Court Register office.

-               I have the honor to hereby inform you of the following:

1)          Informed by the Secretary of the European Court that the Romanian State on 2/10/2009 sent by mail in the court their observations. But until today 19/11/2009 post didn’t give those documents to the Court.

2)          I understand that on 2/10/2009 Romanian State faxed to the encounter, but can not be examined because it required original documents and not copies.

In light of all the above informed both, the Greek Ministry of Foreign Affairs, Department of International Judicial Affairs and the Romanian Foreign Affairs and asked their help to finally be a solution to the impeccable of my case.

-        After all this above inform and the Court that:

The Romanian State was and is unreliable in my case and any delay matchmaker in my case suspected. Because wants to cover political and Judicial bodies who literally stole my property without to respect the terms of the European Convention of the property protection and the terms of the human Rights.

From other part I, if I was imprisoned and constantly pressed by the inhuman conditions of my prison. I was always consistent in my obligations towards any requirement of the HUDOC and are always presented in the requested documents to any time, in spite of the obstacles I had to face, obstacles that was applied the Romanian State and all I had write and proved in my application.  

But as evidenced by the Romanian State is not consistent, and if the 15.05.2009 has been updated, if and helped with the decision by 2/04/2009 and was given until 2/10/2009 to submit their observations. So far I have not presented the documents to answer in accordance with the regulations of the European Court.

-               Then such all the above the following:

To cancel any objections of the Romanian State as out of the limit-time and force the Romanian State to respect the European Convention in the accordance with the Article 41 and to accept an amicable settlement to finally my suffering from 1998 until today.
